Your point is a good one, which is why proposals to continue testing
license holders (such as one recently put forth by the govenor of
Mass). Regardless, even if one believes in a no fault approach, it
rarely runs to 50/50. As such, the scales always tip one way. As she
didn't take appropriate care, then she clearly holds the great
portion of the fault.
